Terms of Service
I. GENERAL
- Please be specific about what you request. The less references provided to me, the more creative liberties I will take.
- I do not consent to my art being used for NFTs or any cryptocurrency-based transactions.
- If you fail to follow the rules I have provided, I reserve the right to decline your commission.
II. PAYMENT AND DEADLINES
- Payment is upfront and accepted exclusively via. PayPal in AUD. I will request for your associated email and send you an invoice for the commission.
- If I expect that I am unable to reach the deadline that you propose to me initially, I will express this and refuse the commission if said deadline is non-negotiable.
- If the deadline is unspecified, it will be completed in three months at the latest. I will always aim to complete the commission ASAP, but this budgets for unforeseen commitments (school, family etc.).
- If, due to unforeseen circumstances, I am unable to complete the artwork by the deadline that we agreed upon, I will inform you ASAP. See section IV: ‘Permissions and Copyright’ for details of entitlement to a partial refund in the case that the deadline that was agreed upon is not achieved or unable to be.
III. PROCESS
- You reach out to me via. Twitter DM with which style of artwork you’d like to commission, your request, deadline, and reference imagery.
- I respond with whether or not I am capable of taking your request and any other relevant discussion. After details are agreed upon, I will send an invoice to the email linked to your PayPal account for full upfront payment.
- I begin the artwork once payment is received. From this stage onwards, you are not entitled to a refund unless the circumstances are exceptional per section V: ‘Cancellation and Refund Policy’.
- I show you my rudimentary sketches for your approval. You communicate any changes you would like to be made. You cannot request a holistic revision at this stage, but may ask for alterations to be made to the pose, expression, etc. This is the last opportunity you will have to request significant changes to the artwork.
- Sketch-style commissions are exempt from the previous term. Commissioners of sketch-style artwork may only request minor changes, such as slight revisions of expression or proportions, for example. I have the right to refuse requests for major changes to the artwork. Please be specific about your request before I begin.
- I proceed as advised, occasionally show you my progress, and communicate with you about any uncertainties I may have.
- I show you the finished piece for you to request any reasonable minor changes to. This may involve slight revisions of colour, hand placement or other proportions, for example. I have the right to refuse requests for major changes to the artwork.
- After the artwork is finalised and your approval is received, I send you the completed files.
- The commission is complete. Thank you!
IV. PERMISSIONS AND COPYRIGHT
- I possess total copyright over all of my artwork. The commissioner does not have the right to sell, claim rights to, or claim creation of any commissioned artwork.
- Commissioned artwork is strictly for personal and non-commercial use by the commissioner only, unless otherwise is agreed upon prior to the commencement of the artwork. For interest in commercial use, please inquire directly. Personal use does not allow for significant alterations to be made to the artwork.
- Commissioned artwork is watermarked. The commissioner does not have the right to erase this from the artwork.
- Unless otherwise agreed upon prior to the commencement of the artwork, I am allowed to use the artwork under any circumstance (such as self-promotion, portfolio display, public posting, etc.). This will always be done with credit for the design of OCs.
- Please credit me in any form of public non-commercial use of the artwork.
V. CANCELLATION AND REFUND POLICY
- I have the right to cancel and refund the money for your commission at any time.
- Commissioners have the right to cancel the commission only if money has not been sent yet.
- Commissioners have the right to a partial refund only if the deadline agreed upon by both parties prior to the commencement of the artwork was not achieved, with the size of the refund depending on what progress has been made. Otherwise, commissions are strictly non-refundable after payment is sent. The commissioner does not have the right to cancel the commission or demand a refund from the artist under any other circumstances after payment is received.
